These terms govern your use of the Travel South Africa operations dashboard. Please read them carefully.
These terms and conditions (the Terms) are the agreement between you (the Client) and Travel South Africa, a service of Pro Web Design (we, us or the Provider). They apply when you sign up for, or use, the Travel South Africa operations dashboard and everything that comes with it (the Service).
By ticking the acceptance box when you sign up, or by using the Service, you agree to these Terms, our Privacy Policy, our Data Processing Agreement and our Refund Policy. Under the Electronic Communications and Transactions Act 25 of 2002 (ECTA), your electronic acceptance is a valid agreement and does not need a signature.
If you sign up for a company or other organisation, you confirm that you are authorised to bind it, and the Client is that organisation.
As required by section 43 of the ECTA, these are our details:
The Service is a hosted operations dashboard for transport companies. It includes, depending on your plan, booking forms for your website, dispatch, drivers and vehicles, pricing, payments and invoices, WhatsApp bookings, connections to booking providers, a team and audit log, and the account and support tools inside the dashboard. The main features of each plan, and its limits, are shown on our pricing page.
Each Client has a separate dashboard and its own data. The Service is provided online. You need your own internet access and equipment.
You must be at least 18 years old and able to enter into a binding agreement. The details you give us when you sign up must be correct and kept up to date. You are responsible for everything done under your account, and for keeping your login details safe. Tell us immediately if you think someone else has used your account.
The owner of the account decides who else gets a login and what role they have. Each person must use their own login.
Each plan starts with a free trial of 15 days. You do not need to give a card to start. The trial gives you the features and limits of the plan you chose.
Before the trial ends we remind you to add your payment details. If you do not pay when the trial ends, your dashboard is paused after the grace period set out in clause 8, and your data is kept as set out in clause 10. We may limit a free trial to one per business and may refuse a trial, for example where we find that the same business or person has already had one, or where an email address or connection looks abusive. For this we keep only coded (hashed) records, as described in our Privacy Policy.
Your plan sets limits, for example the number of drivers, users, connected websites, WhatsApp booking numbers and booking provider connections. The service stops you from adding more than your plan allows. You may ask us for more, or move to a bigger plan, from inside your dashboard.
Please use the Service in a way that is reasonable for a transport business of your size. We may act if your use harms the Service for other Clients, for example by sending very large volumes of automated requests.
All prices are in South African rand and include VAT, unless we say otherwise. Subscriptions are billed in advance, monthly or yearly as you choose when you sign up, until you cancel. A yearly plan is charged once for twelve months at the price of eleven.
The optional setup package is a once-off fee, shown at sign up. It is free on the Scale plan.
We may change our prices. A price change applies from your next billing period, and we give you at least 30 days written notice before it affects you. If you do not agree, you may cancel before it takes effect.
Fees charged by third parties are not part of our price. These include your payment gateway fees, Google Maps usage billed under your own key, WhatsApp provider fees and the usage cost of your own AI account.
You must pay each invoice by its due date, using a payment method you have provided. If a payment fails or is missed, we tell you and give you a grace period (currently 3 days) in which the Service keeps working. If the payment is still outstanding at the end of the grace period, we may pause your dashboard until you pay. Online booking on your websites is closed while your dashboard is paused, and your customers see a polite message.
When you pay, your dashboard is switched back on. We do not delete your data because a payment is late.
You may cancel at any time from your account page. There is no contract term and no cancellation fee. After you cancel, your plan stays active until the end of the period you have paid for, and we do not charge you again. Cancelling does not by itself entitle you to a refund. Our Refund Policy explains when we refund.
We may end the agreement or suspend the Service if you seriously or repeatedly breach these Terms and do not fix the problem within 7 days of our written notice, or immediately if you use the Service unlawfully or in a way that endangers the Service or other people. We may also end the Service as a whole by giving you at least 60 days notice, and then we refund the part of any amount you paid in advance that covers the time after the Service ends.
You own the data you put into the Service, including your bookings, customers, drivers and prices. You may export it at any time from your dashboard.
If your plan is cancelled or lapses, we keep your data for 30 days so that you can come back and carry on where you stopped. After that period we delete it, and backups containing it are overwritten in the normal cycle. Our Data Processing Agreement sets out how we handle personal information on your behalf.
You are responsible for the content you load, and for the personal information of your customers, passengers and staff that you put into the Service. You must have a lawful reason to process that information, and you must give those people the notices that the Protection of Personal Information Act 4 of 2013 (POPIA) requires. For that information, you are the responsible party and we are your operator.
You are also responsible for your own licences and permits to operate transport services, for the prices you charge, for the bookings you accept, and for the services you deliver to your customers. The Service is a tool. We are not a transport operator and we are not a party to your agreements with your customers.
You may not use the Service to:
The Service connects to services run by others. Examples are your chosen payment gateway (PayFast, Paystack, Ozow, Yoco, Peach Payments or bank transfer), Google Maps, booking providers such as Transferz, the WhatsApp platform and your own AI provider. Those services are governed by their own terms and prices, and we are not responsible for them. You need your own account with each one that you use. Where a provider has to approve your connection, that approval is theirs to give.
We own the Service, its software, design, text and trade marks. We give you a limited, non-exclusive, non-transferable right to use the Service for your own business while your agreement is in force. You keep ownership of your own data, logos and content, and you give us the right to host and process them to provide the Service.
Each of us must keep the other’s confidential information confidential, use it only for this agreement, and disclose it only where the law requires, or to advisers and service providers who are bound to keep it confidential.
We work to keep the Service available and to fix problems quickly, but we do not promise that it will be uninterrupted or free of errors. We may do maintenance, which we try to do at quiet times. Support is given by email and from inside the dashboard.
We keep improving the Service and may add, change or remove features. We will not remove a feature that is central to your plan without notice and, where it affects you materially, a fair solution.
We provide the Service with reasonable care and skill. We do not give any other warranty, express or implied, to the extent the law allows.
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, bookings, revenue or goodwill, and our total liability to you for any claim arising from the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose. This does not limit liability that the law does not allow us to limit, such as liability for gross negligence, fraud or wilful misconduct.
We are not liable for loss caused by events outside our reasonable control, including power, network and hosting failures, the failure of third party services, or the acts of third parties.
You indemnify us against claims, losses and costs that arise from your breach of these Terms, your unlawful use of the Service, or your dealings with your own customers, to the extent the claim is not caused by us.
The Consumer Protection Act 68 of 2008 (CPA) applies to you if you are an individual, or a company or other juristic person whose annual turnover and asset value are below the threshold set by the Minister (currently R2 million). Where it applies, nothing in these Terms removes the rights that the CPA gives you and that cannot be excluded, including the right to services performed timeously and with reasonable care and skill, and the protection against unfair, unreasonable or unjust terms.
If you are an individual (a natural person), you may also cancel an electronic transaction within 7 days after the agreement is concluded, without giving a reason and without a penalty, as section 44 of the ECTA allows. Our Refund Policy explains how this works together with the free trial.
We may change these Terms, for example when the law or the Service changes. We tell you at least 30 days before a material change takes effect, by email or inside the dashboard. If you continue to use the Service after that date, you accept the new Terms. If you do not agree, you may cancel before the change takes effect.
We may send notices to the email address on your account, or show them in your dashboard. You may send notices to [email protected] and to our address in clause 2. A notice sent by email is taken as received on the next business day after it is sent, unless the sender is told it was not delivered.
For this agreement each of us chooses as our address for legal notices (domicilium citandi et executandi) the physical address that appears in clause 2 for us, and the address given on your account for you.
If we have a dispute, please first write to us and we will try in good faith to resolve it. If we cannot, either of us may refer it to mediation or to the National Consumer Commission or another body that has jurisdiction, or to a court. Nothing prevents you from using the rights and remedies the CPA gives you.
These Terms are governed by the laws of the Republic of South Africa. Subject to the CPA, you and we agree to the non-exclusive jurisdiction of the [Western Cape Division of the High Court, or the magistrates’ court for the district where we have our address].
These Terms, with the documents they refer to, are the whole agreement between us about the Service. If any part is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we do not lose it. You may not transfer your rights or duties under these Terms without our written consent. We may transfer ours to a successor to our business, and we will tell you.
